ONLINE STORE TERMS AND CONDITIONS
The owner of the online store Tuunerstuudio.ee (hereinafter Online Store) is Tuunerstuudio OÜ (registration code 16610350), located at Ravila tn 57, 51014.
Validity of the Sales Agreement, Product, and Pricing Information
These terms and conditions apply to purchases of goods from the Online Store.
The prices of products sold in the Online Store are indicated alongside the products. The price is added to the delivery cost. All prices of products sold in the online store are in euros. All prices include VAT.
The delivery cost depends on the buyer’s location and the chosen delivery method. The delivery fee is displayed to the buyer when placing an order.
Information about the goods is provided directly alongside the goods in the Online Store.
Order Placement
To order goods, add the desired products to the shopping cart. To complete the order, fill in the required data fields and select the appropriate delivery method. The total amount will then be displayed on the screen, which can be securely paid through the following payment methods:
- Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Bank
- Estonian pay-later solutions: Liisi Installment
- Latvian bank payments: SEB, Citadele, and Luminor
- Lithuanian bank payments: Swedbank, SEB, Luminor
- Bank transfer based on prepayment invoice
NB! When paying via bank link, be sure to click the “Back to merchant” button on the bank’s page.
Payments are processed by Maksekeskus AS. Payment takes place outside the online store’s secure environment – when paying via bank link, in the respective bank’s secure environment, and when paying by credit card, in Maksekeskus AS’s secure environment. The seller does not have access to the customer’s bank and credit card information. The contract becomes effective upon receipt of the payment amount to the online store’s bank account.
If it is not possible to deliver the ordered goods due to the goods being out of stock or for another reason, the buyer will be notified at the earliest opportunity, and the paid amount (including the cost of delivery) will be refunded promptly but no later than within 14 days of the notice.
Delivery
Goods are shipped to the following countries: European Union.
The buyer has the following options to receive the goods: self-pickup option, delivery by courier.
Delivery partners are Itella, Omniva, DPD, UPS, FedEx
The delivery costs are borne by the buyer, and the corresponding price information is displayed alongside the chosen shipping method.
Domestic shipments in Estonia generally reach the destination specified by the buyer within 1-10 working days from the time the sales agreement takes effect. Delivery outside Estonia takes 1-30 calendar days.
In exceptional cases, there is the right to deliver the goods within 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-store within 14 days.
NB! Depending on the products, the buyer may not have the right of withdrawal; such products and services must be listed, and they must comply with the conditions listed in § 53 lg 4 of the Law of Obligations Act.
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day return right, the ordered goods must not be used in any other way than necessary to ascertain the nature, characteristics, and functioning of the goods in a manner as allowed for testing goods in a physical store.
If the goods have been used for purposes other than necessary to ascertain the nature, characteristics, and functioning of the goods or if they show signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the goods.
To return the goods, a declaration of withdrawal from the purchase must be submitted in free form and sent to the email address info@tuunerstuudio.ee within 14 days of receiving the goods.
The cost of returning the goods is borne by the buyer, except in cases where the reason for the return is that the item to be returned does not match the order (e.g., incorrect or defective product).
The buyer must return the goods within 14 days of submitting the declaration or provide proof that the goods were handed over to the carrier within that period.
Upon receipt of the returned goods, the Online Store will refund all amounts received from the buyer under the contract without delay, but no later than within 14 days of receiving the withdrawal declaration.
The Online Store may withhold refunds until it has received the item that is the subject of the contract back or until the buyer has provided evidence that the item has been returned, whichever occurs first.
If the buyer has expressly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store is not obliged to reimburse the buyer for the cost exceeding the usual delivery method.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store was significantly lower than the market price of the goods due to an error.
Warranty Rights
The Online Store is responsible for any non-compliance or defect in the goods sold to the buyer, which was present at the time of handing over the item and which appears within two years of the item being handed over to the buyer. Within the first six months after handing over the item to the buyer, it is presumed that the defect was present at the time of handing over the item. The Online Store is obliged to rebut this presumption.
The buyer has the right to contact the Online Store no later than two months after the defect appears by sending an email to info@tuunerstuudio.ee.
If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Online Store will refund all fees incurred under the sales contract.
The Online Store will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store only uses the personal data entered by the buyer to process the order and to deliver the goods to the buyer. The Online Store forwards personal data to the transport service provider to deliver the goods.
TuunerStuudio OÜ is the responsible data controller, and TuunerStuudio OÜ transmits the personal data necessary for processing payments to the authorized processor Maksekeskus AS.
The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed their wish to receive direct marketing communications by entering their email address on the website and indicating their wish to receive direct mail notices.
The buyer can at any time opt out of receiving offers and newsletters sent to the email by notifying us by email or by following the instructions included in the email containing the offers.
Dispute Resolution
If the buyer has complaints about the Online Store, they should be sent to the email address info@tuunerstuudio.ee.
If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The conditions for proceedings can be reviewed, and an application can be submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from contracts concluded between the buyer and the Online Store. The examination of the buyer’s complaint in the committee is free of charge.
The buyer may turn to the European Union’s online dispute resolution platform.
